Nintendo has lost in their attempt to have a patent-infringement verdict overturned and are now facing a US ban on their Wii Classic Controller, WaveBird controller and Nintendo GameCube controller.
Last month, the privately held Anascape Ltd. won the infringement case against the video game giant and yesterday U.S. District Judge Ron Clark through out Nintendo's request for a new trial in the case.
The injunction will be put on hold however while Nintendo appeals the case to the U.S. Court of Appeals for the Federal Circuit. Nintendo will have to put royalties in an escrow account however or the ban will go on as planned, appeal or not.
"Nintendo was already planning to appeal this case to the Federal Circuit court," Nintendo spokesman Charlie Scibetta said. "The recent ruling by the trial court does not impact that decision."
Scibetta added that once the royalties are posted, the company will "immediately appeal" the decision. The company has since discontinued making the GameCube and WaveBird controllers but the Wii Classic Controller continues to be a big seller.
Fortunately for Nintendo, the Wii-Mote and "Nunchuk" attachment were found to not violate the patents involved in the case. The patents covered "certain configuration of the remote to control six types of motions at the same time" and were developed by inventor Brad Armstrong of Anascape.
The company wanted the injunction on the controllers because Anascape wants to enter the market and believes "Nintendo has clogged the channel." Sony licensed the patent in 2004 and Microsoft settled out of court in May to avoid a trial.

A unique donation will ease the interview process for child crime victims.
Today, CD Tradepost handed over a new GameCube system to the Police Department's Crime Victim's Assistance Unit.
The new equipment and games will be used to improve the unit's interview room and make it more comfortable for young crime victims.
"Children that are in domestic violence or have violent acts committed against them have a little time," said Dawn Maendele of the Victim's Assistance Unit. "They're sitting there thinking about things that've happened. These games will allow them to divert attention to something else, even for a short period of time."
The Crime Victims' Assistance Unit began in October 2002.
Since then, it has helped more than 7,700 victims of crime.

A number of independent games retailers have joined forces with the Entertainment Retailers Association to call for action against R4 cards.
Shop owners have claimed the prevalence of the device has cost them much needed revenue and significantly damaged sales of DS software.
"Since the appearance of these cards we have noticed a downturn in the sale of our DS games," said indie shop owner Steve Pooler to MCV. "It is frustrating as we could make decent margins on the DS. Sadly this has now been eroded with the growth of these cards."
If one were so inclined, they could buy an R4 card for around £20 from respected online retailers, and then illegally download games for nothing. In comparison, DS games can cost £29.99 each.
Unsurprisingly, the ERA isn't happy about that. Representative Kim Bayley said: "We expected that the piracy suffered by movies and music would make its way to games, and it's something we all need to get a grip on.
"The industry needs to be on its toes and take advantage of the digital models already in place."

Nintendo added a new Channel to the Japanese Wii interface today. Joining the growing lineup of non-game tools for the system is the Wii Digital Camera Print Channel, a channel that lets users print pictures and more.
With the new channel installed, Wii owners will be able to select digital pictures to be printed and delivered at a cost of 30 yen per print. The channel also assists in creating a Wii Photo Book, a special photo album that's available in multiple sizes, with costs ranging from 1,575 yen to 2,480 yen.
Even more closely related to the Wii is the channel's Wii Business Card service. Users select one of six templates featuring Nintendo characters, add either a real life photograph or a Mii, and finalize their cards with the requisite details, like address, phone number, or even Wii friend code. Printing costs run 500 yen for a set of 30 cards.
Fuji Film is working with Nintendo for this physical part of this channel. On top of the costs listed above, users will have to pay shipping fees at rates of 500 yen for express and 200 yen for standard mail.
As with the other Wii Channels, Nintendo has global plans for the new channel. Wii owners in North America and European markets can look forward to similar print services in the near future.

Great news, Nintendo fans! Nintendo has released its latest WiiWare game over in Japan. The bad news is revealed by the title: Tsuushin Taikyoku Hayazashi Shogi Sandan. Hidden within all the moon talk is one of those dreaded words from the Japanese game market: shogi. That's right, Nintendo's latest WiiWare title is the download service's latest shogi game.
Hayazashi Shogi Sandan boasts online play via Wi-Fi Connect as well as offline play for two players and versus the CPU. Those who do chose to go against the Wii hardware will find advanced AI routines through the TACOS AI system that was developed at the Japan Advanced Institute of Science and Technology.
Solo players have a couple of exclusive modes as well. The game includes a shogi course for beginners, teaching everything players need to know about the chess killah. Also included is a tsumeshogi mode, where players can test their skills at over 200 problems. This mode offers problems for both beginners and advanced players.
This latest Nintendo branded WiiWare title is available as of today for Japanese Wii owners. Nintendo is asking its usual 1000 WiiPoints. The title will likely stay in Japan, so shogi fans should dig out that import Wii system.
For a closer look at the game ahead of purchase, check out the official site Nintendo opened up today.

Reggie Fils-Aime has said that he would love to see a Grand Theft Auto game on Wii, claiming that Nintendo and Take Two have a good relationship.
"A 'GTA' on the Wii is all based on what Rockstar and Take Two want to do," Reggie said whilst speaking to MTV.
"And again, from our standpoint, if they build a bottoms-up game that takes advantage of what we do well, I'd love to see it on the platform." You and every hardcore Wii owner, Reggie.
Despite his desire, the NoA president did admit that he had yet to have a conversation with Take Two about the possibility of a GTA title coming to Wii.
Call it a hunch though, but if the Wii user base keeps growing Rockstar would be mad not to start at least a side project for it. After all, it's fast running out of PS2 games to port over...

The US patent and trademark office has revealed a file by Nintendo for a controller that senses vital signs, including blood pressure.
The filing 'summarises' what the device can do in a lengthy sentence. Here it is:
"A wireless controller for a video game console is disclosed and includes a main body including a measurement unit including a control circuit including a first amplification circuit, a control IC, a second amplification circuit, an ADC, a display circuit, and pins for setting, a top recess, a display, two first measurement devices adapted to contact the fingers as the hand holding the main body for measuring pulse and body temperature of a user playing a video game on the video game console, and a rotation counter for counting the number of rotations of the main body; a control unit mounted in the recess; a band including two second measurement devices for measuring blood pressure and pulse respectively by wrapping the band around the wrist; and a cable interconnecting the main body and the band."
Blood pressure, pulse and body temperature values will also be shown on the display whilst the 'game' is played.
It sounds a lot like a complete medical check-up kit for Wii. Our natural assumption is that this is the patent for whatever peripheral is to be bundled with the inevitable Wii Fitter.

We'll level with you: the game industry confuses us. For example: you'd think with games like Star Wars: The Force Unleashed and Clone Wars, not to mention the recently announced Sonic and the Black Knight, coming to the Wii that Nintendo would have been eager to get the MotionPlus into dev's hands as quickly as possible. Not so, as Game Informer learned when they asked several third-party developers about the peripheral.
Turns out the site uncovered a "general feeling ... of annoyance and betrayal" that Nintendo shared the existence of the device with third parties at the exact same time they shared it with us. Game Informer estimates it would take some six to nine months to incorporate MotionPlus functionality into games and that it's probably too late for games "deep in development." With Wii Sports Resort not due until Spring 2009, that might be just enough time to build some support into upcoming titles. So, let's recap: at Nintendo's E3 showing, they managed to not only piss off every "core" gamer in existence but a good number of their third-party developers as well. Impressive?

Nintendo has announced that the Wii is the fastest selling home console to break through the 500,000 units sold milestone in Australia.
Research conducted by GfK Australia shows that the sales mark was reached in just 84 weeks since the launch of Nintendo's console in the region. The Wii beat out the previous record holder, which reached the 500,000 goal in 107 weeks, making the Wii 23 weeks faster.
Nintendo's console has been in high demand since it launched and has suffered from hardware shortages. In a recent interview, Nintendo's CEO Satoru Iwata said the company couldn't guarantee Wii supplies for Christmas.

has said we have seen "the extent" of what the company is offering this Christmas.
Dunaway was defending the lack of core Wii games shown at the E3 press conference last week - something that Nintendo overlord Satoru Iwata apologised for recently.
"Absolutely the hardcore gamer crowd is critically important to us," Cammie Dunaway told Wired. "But we announce what we have that's ready to share.
"And so we don't talk about stuff until we've got a great degree of confidence that we're close enough to release it. So we announce what we have. And we're really proud of what we have coming in to this holiday season.
"You have seen the extent of Nintendo's 2008 holiday line-up," she added.
Animal Crossing, Wii Music, Wario Land: Shake It, Super Mario Sluggers and Call of Duty were all mentioned by Dunaway as games for the core audience this year.

Retailers may be facing another year without enough stock of the Nintendo Wii to meet consumer demand.
Nintendo's CEO has said that while the company will do all it can to satisfy demand, it cannot guarantee full supplies for the third year running.
"We are really intending to increase the shipments to the US, especially compared to last year," says Iwata, speaking to Forbes.
"However, I can't give you a 100 per cent commitment [that you'll be able to find a Wii this holiday season]. What I can commit myself to is that Nintendo is going to do its best to supply as many Wii hardware units as possible in order to meet demand there."
The company has ramped up its production of the Wii from 1.8 million units per month to a target of 2.4 million by the end of the summer.
Last Christmas retailers in the US and Europe suffered shortages of the popular home console, and while sales of the Wii are leaving the competition behind, consumers and retailers could once again face a frustrating seasonal period.
Nintendo of America boss Reggie Fils-Aime has said that the average unit sits on retail shelves for only an hour before being snapped up.
It's not just the console that has suffered from a poor supply chain. Game and peripheral Wii Fit has jumped in and out of the charts since release with analysts suggesting patience amongst consumers could wear thin if they are not able to buy product so heavily advertised.

News via Nintendomax:
Updated release from Kriogen:
Now comes a color around the letter shows, that color is the color you have chosen the last player who put a wildcard.
Description:
This is the card game Uno, can play from 2 to 4 players via the Internet (or local area network). As I have only 1 Wii I could not see if it works perfectly, I have refined using Telnet 3, so as not operate in the Wiis not act as a server, but theoretically should work well.
DIRECTIONS:
In the main menu indicates if it wants to act as a server for 2 to 4 players or want to become a customer, once selected you'll have to wait until all players are connected. As all are connected server distributed charts and start playing the first connected user (normally the player who acts as a server, but could be another if someone connected before this establish its own connection).
If you have more cards in your hand you can see (more than 7 letters) you can move hand with the left and right buttons.
To select a letter you put on top and press B (the letter selected will appear in the foreground as you move your hand), if you have no cards to make (or think you do not have) hit the button and draw a new 2 letter. Clicking the button home saldrás your turn the game, but other users are blocked (expects to receive from a socket that no longer exists)
If this is not your turn seem that the game has been hanged, but is not so.
Configurations:
Edit server.xml and adjusts the server's IP and port with which want to connect (if you're going to act as a server you also have to configure, but it can be the IP private rather than public)
Final note:
The graphics that are already very cumbersome, but I have not found pictures of Uno cards and needed something fast to debug the program graphically. If someone is a good package curra graphic serious appreciated that the Post.
As I said at the outset have not tried it with more Wiis only with Telnet, if you see bugs please posteadlo.
The file does not cartas.xml toqueis, if only the route of the images, but other data should be equal in all consoles or not function well.
Cos outstanding:
-- Improved graphics.
-- When using a wildcard color (normal or letters +4) is the next player who can put the color you want, be the same player who has put the letter, if this version works well add this in the next .
-- If someone leaves the game to warn other players to disconnect
